TERMS & CONDITIONS

Please read these terms and conditions carefully before completing a booking.

By making a booking with Chris Packe (“we” or “us”), you accept these terms and conditions.

1.      Payment

All bookings are made through the Eequ booking platform.  Funds will be held by Eequ until the conclusion of the Activity and only paid out to us then.  For Youth Programmes where payment is in instalments, you be asked to pay each instalment on clearly agreed dates.  If the balance is not paid in time, we reserve the right to treat the agreement as cancelled by you, and subject to a cancellation charge. 

2.      Cancellation by you

The cancellation policy for each Activity is set out on the Eequ booking site. We charge you fees for cancellation since we incur costs in preparation for an Activity.

3.      Cancellation by us of an Activity

We may be forced to cancel an Activity before it starts, possibly on short notice. In particular this may happen where there is inclement weather. In these circumstances we will refund you all monies paid in connection with the cancelled Activity. Similarly there may be occasions when, for no fault of ours, we are forced to bring an Activity to an early close, in which case there will be no compensation.

An Activity is in part a social event and benefits from the presence of a critical number of persons. If we, in our absolute discretion and without need to give reasons, determine that a critical number will not be present we reserve the right to cancel an Activity at short notice. In these circumstances you will be refunded all monies paid in connection with the cancelled Activity.

TERMS OF PARTICIPATION 

4.      Accepting the risks 

The activities we run (‘the Activities”) involve physical exertion and exposure to changing weather conditionsand can be physically, mentally and emotionally demanding. This may activate or aggravate existing medical conditions. Personal injury and, in extreme cases, death may result. 

We make every effort to minimise risk to participants and to instruct participants in the safe negotiation of such risks as may remain. 

By signing up for one of these courses you accept these risks and agree that it is your responsibility, and the responsibility of the participant you are booking for, to make sure they are healthy enough to participate. You acknowledge that there are circumstances in which an accident could befall a participant without our staff being at fault and you accept that the participant is taking part in the Activities at their own risk.

5.      Limits to liability

You understand that we accept no responsibility for loss, damage or injury caused during participation in any Activity, except where the loss, damage or injury was caused by our negligence. 

6.      Expected Conduct of Participants

You acknowledge that during an Activity the participant is required to submit to the reasonable instructions and leadership of staff, save that parents, teachers and those in comparable roles in respect of children attending an Activity must maintain control of those children, to the satisfaction of our staff.  

You acknowledge that people attending an Activity are entitled to expect a high standard of conduct and regard for personal well being on the part of all participants.

You accept that we may, in our absolute discretion and without the need to give reasons, require that a participant is removed from an Activity, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; failure of control over children; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of an Activity.  In such circumstances you will not be entitled to a refund of monies and we will not be liable for any resulting losses. You will on demand reimburse any reasonable costs we incur in effecting his/her removal.

7.      Medical matters

You must make us fully aware of any medical problem, condition, disability, injuries or medication of a participant prior to booking.  If any of these medical issues change, arise or are suffered, between booking and the commencement of the course then we must be notified immediately.  

We reserve the right to refuse or cancel a booking on medical grounds, if it might be detrimental to the safety and smooth running of the course. If cancelled, you may be required to pay cancellation charges (see paragraph 7 below).

If there is any doubt as to the level of fitness required for a particular course or activity, please contact us.

At least one staff member on any Activity will hold a valid certificate in outdoor first aid.  You confirm that you consent, as a parent or guardian of a participant, for qualified staff to administer first aid should the need arise, in the manner they deem fit according to the circumstances.

8.      Equipment

A participant is responsible for their own personal property and equipment and for ensuring it is suitable and safe for use on the course.  We will not be responsible for any loss or damage to a participant’s personal property or equipment used on a course.

If we issue a participant with property or equipment for use on a course, they will be responsible for its safekeeping and proper use. We reserve the right to charge for any property and / or equipment lost, damaged or misused by a participant on a course.

OTHER TERMS

9.      Personal data

We collect personal data that we need to fulfil our contract with you and communicate with you. We will never sell your personal data and will only share it with individuals and organisations we work with to fulfil our contract with you.

We may collect sensitive personal data about participants such as date of birth, next of kin, and details relating to physical and mental health. We collect this to ensure the safety and well-being of participants. As with all the personal information we hold, this data is dealt with sensitively and is stored with restricted access.

We will not keep personal data longer than is appropriate, taking account of our other legal and insurance related responsibilities.

Please contact us if you have any questions about this policy, would like us to remove you from any communications, or if you would like to request a copy of the personal data we hold about you or a participant. 

10.    Insurance

We are covered to a level of £5,000,000 for Public Liability. You are strongly advised to take out personal insurance of the type available to holiday makers, to cover the risks ordinarily covered by such policies, including personal injury, loss of belongings and money and cancellation.

11.    Complaints

If you feel you have cause for concern or complaint about an Activity, please speak to a member of staff during the Activity, not afterwards, so corrective action can, as appropriate, be taken. In any event, should you wish to bring a complaint please do so no later than 30 days after the Activity to allow us to deal with it effectively. 

12.    Governing law

These terms, and any rights and obligations between you and us, shall be governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes between us.
